General Terms and Conditions of the Online Shop of Atelier Ayano

Scope of application and contractual partners
The following terms and conditions of sale apply exclusively to all our deliveries. Your contractual partner for all orders is Atelier Ayano. (for address for service see point "9. address/imprint" of the general terms and conditions).

Conclusion of contract
The conclusion of the contract in the online shop takes place exclusively in English. Before sending your order, you will be given the opportunity to check all details (e.g. name, address, method of payment and ordered items) again and to change them if necessary. When you have gone through the ordering process in the online shop, providing the information requested there, and click on the "Buy" button in the last step, you are placing a binding order. The contract is concluded with Ayano Sasaki, unless expressly stated otherwise.
After you have sent your order, we will send you an e-mail confirming that we have received your order and listing its details (order confirmation). This order confirmation does not constitute an acceptance of your offer, but is only intended to inform you that we have received your order. You will receive all customer information from us by the time the goods are delivered at the latest, which you should keep for your records. The contract of sale is not concluded until the goods have been dispatched and the confirmation of dispatch has been sent to you by e-mail. If payment in advance is not received within 14 days of the order date, the order will be cancelled. We reserve the right to limit the acceptance of an order to quantities customary in the household.
Prices
All prices are end consumer prices and do not include shipping costs. The respective price shown at the time of the order shall apply.
Delivery and shipping costs
We deliver subject to availability. If an item is sold out or currently not available, it is not possible to order the item. Any claims for damages due to the unavailability of the items are excluded.
Commercial resale is not permitted.

the delivery of our goods is carried out exclusively with the Austrian Post AG and DHL and is only possible to a postal address in Europe (excluding overseas territories). Unless otherwise agreed, delivery will be made to the delivery address provided by the customer.
The delivery time depends on the selected payment method. Within Austria, Germany and Switzerland it is usually 2 to 5 working days from dispatch. Standard shipping for Austria is € 4.90, for Germany € 5.90. From an order value of € 80.00 the delivery is free of charge! All other EU countries 5 to 8 working days and more, from order, standard shipping is € 9,90.
From an order value of € 120,00 the delivery is free of charge!

Several products ordered at the same time will be delivered in a joint consignment. The delivery time of the product with the longest delivery time applies to the joint shipment.
If, for technical or logistical reasons, the shipment is made in several stages, we will only charge a single shipping fee.
If the delivery to the customer fails, if a wrong or incomplete delivery address is given, a new delivery attempt will only be made if the customer bears the direct costs of the new shipment. The costs correspond to the costs agreed upon when the contract was concluded.

We will inform you of the necessary costs of a new delivery by e-mail, after receipt of payment of these costs a new shipment will take place.

Warranty and limitation of liability
Our products are protected as well as possible against damage in transit with FREE gift packaging and additional bubble wrap. Should delivered items nevertheless show obvious material or manufacturing defects or transport damage, please report this immediately to us or to the carrier who delivers the items. The customer is not obliged to do so and this is not a prerequisite for asserting your claims. However, we cannot otherwise assert any claims against the carrier. Compliance with the above provision shall not affect your statutory claims insofar as you have ordered for private purposes as a consumer. Insofar as a defect subject to warranty exists, your warranty rights shall be governed by the statutory provisions. In these cases, you can request a return label for the return from our customer service at any time. We are entitled to refuse the type of subsequent performance chosen by you if it is only possible at disproportionate cost and the other type of subsequent performance remains without significant disadvantages for you.
Return shipping costs agreement
If you exercise your right of cancellation by post, you must bear the direct costs of returning the goods. This also applies if you only partially revoke the contract.

Right of withdrawal
You have the right to cancel this contract within fourteen days without giving any reason. The revocation period is fourteen days from the day on which you or a third party named by you, who is not the carrier, has or has taken possession of the goods.

To exercise your right of withdrawal, you must inform us of your decision to withdraw from this contract by means of a clear declaration (e.g. a letter or e-mail sent by post).

In order to comply with the revocation period, it is sufficient that you send the notification of the exercise of the right of revocation before the expiry of the revocation period.

You also have the option of declaring the revocation within the revocation period at the same time as returning the goods to any Bijou Brigitte shop. In this case, the delivery costs will not be refunded.

Consequences of cancellation
If you cancel this contract, we must refund all payments we have received from you, including delivery costs (with the exception of additional costs resulting from the fact that you have chosen a type of delivery other than the cheapest standard delivery offered by us), without delay and at the latest within fourteen days of the day on which we received notification of your cancellation of this contract. If you only partially revoke the contract, we will not reimburse you for the delivery costs due to their flat-rate nature. For the repayment, we will use the same means of payment that you used for the original transaction, unless expressly agreed otherwise with you.
We may refuse repayment until we have received the goods back or until you have provided proof that you have returned the goods, whichever is the earlier.
You must return the goods to us immediately and in any event no later than fourteen days from the day on which you notify us of the cancellation of this contract. The return shipment is to be sent to the address stated in Clause 8. The deadline is met if you send the goods before the expiry of the period of fourteen days. You shall bear the direct costs of returning the goods.
Your right of revocation expires prematurely in the case of contracts for the delivery of sealed goods which are not suitable for return for reasons of health protection or hygiene if their seal has been removed after delivery.
You only have to pay for any loss in value of the goods if this loss in value is due to obvious damage or handling of the goods that is not necessary for checking the condition, properties and functioning of the goods.

You agree that contract-related communication - in particular the delivery of the invoice and revocation information - may take place in electronic form.
